What i found was that both the pen and touch and the ELAN drivers were watching the touchpad and they were both trying to move the mouse. The jumping around was the result of the two fighting each other.

Now it is actually a really nice touchpad.
Good suggestion mate. Might help people who are experiencing the same problem.
