Well the bad news is that uxtheme.dll really shouldn't have any effect on the actual nuts and bolts of the theme so it's kinda hard to figure out what's happening there.
I would try installing the theme using the application I've attached (it's standalone, no install required) to see what the theme is actually supposed to look like before you do anything else. If it still doesn't meet your needs then you should first approach the theme's author via the Deviant Art page explaining your special requirements and asking for a tweaked version. This is not only common courtesy but also a safeguard against any copyright problems arising.
