    I have used the disk before. Would a scratch on the disk cause this?

    Use Step 1 and 2 from Clean Reinstall - Factory OEM Windows 7
    then follow the steps to get a perfect reinstall.

    In addition wipe the HD first with Diskpart Clean Command
    from the installer's Command Line.
