    iPod Touch explodes in a child's pocket


    Apple's iPod Touch is one of the hottest devices around and unfortunately for one youngster it got so hot that it exploded in his pocket.

    The mother of a child living in Cincinnati is suing Apple and ten unnamed retail employees for "gross negligence and recklessness, as they supposedly conducted themselves maliciously and fraudulently when selling the iTouch".

    This is just another example of American stupidity. And greed. Its pathetic.
    As stated in the article, the low melting point of Nylon is 374 degrees Fahrenheit. How the HELL could you NOT notice something like that in your POCKET!?!?!?!?!?!
    The fact that they are suing for "supposedly conducted themselves maliciously and fraudulently when selling the iTouch" is stupid. I think the company should counter-sue for them being dumbasses. I would fully support that.

    If I was the judge, I would throw it out, give all charges to the idiots, and tell them to have the kids nervous system checked, because he obviously could not feel 374 degrees of heat in his pocket.

    I think it is much more likely the kid was messing with his iPod, trying to mod it or something else, and accidentaly lit it on fire.

    It's not apple's fault this kid loaded up his ipod with hot tunes.....

    Seriously though, if a device exploded on me I'd be happy with my money back plus a few freebies for my "emotional distress".

    On a serious note ...

    It is important that this type of case does get to go before the court, assuming that the evidential details are enough to warrant it.

    There have, I believe been other reports of battery problems with iPod devices, and unfortunately large companies often only act when a legal requirement is placed on them. This is not an attack on Apple, before anyone suggests that, as the same would apply if it were a Zune Player or something from one of the other large players.

    As for the amount of damages sought I believe this to be in the realms of a token amount when compared to some suits in recent history.

    The thing that worries me is that although the youngster involved here has suffered, totally unacceptable distress, If this is an inherent fault then the next person could be even worse off.

    I have to disagree with some of you. First off, I am the first person to get angry when I see some of the lawsuits people file and actually win. Like the McDonalds one several years ago when that lady spilled coffee on herself, i heard she got millions from that. Or the lady that put her camper on 'cruise control' and went to the back of the camper thinking it was on auto pilot. Of course it crashed and amazingly she won a million or so in a lawsuit. That sort of stuff is just beyond insane how those type of things were even allowed in court.

    But this is different. If indeed, his Ipod 'exploded' and caught him on fire, I have no problem with him looking for cash. Who would ever expect their Ipod to explode and catch you on fire?! I am not saying he is intitled to millions, but Apple should fork over some money to pay for expenses and what not. Your Ipod should never catch you on fire. I dont think there are any warnings or conceptions that it would ever happen.
