Here you go, from the AMD website.
Socket AM2+ Phenom II processors are not compatible with AM3 motherboards. Forced installation can cause damage not covered by AMD warranty
Newegg has covered their butts with this:
Newegg.ca cannot guarantee the compatibility of Combo items. Please contact the manufacturer(s) directly if you have issues or concerns regarding compatibility.
Everyone gets one of these,
Sad part about that combo is despite the disclaimer, how many will buy it not knowing that the CPU is totally incompatible with the motherboard?
I'm not sure whether or not that would be legally valid. An item purchased must be fit for its purpose and without any defects. So as far as I'm concerned (and I'm not a lawyer or have any legal training), I would have to say that it is not fit for purpose as the processor would not work with that motherboard. If Newegg.ca (or indeed any other vendor) wishes to offer motherboard/processor bundles then it is upto them to ensure that the components that they offer as part of that bundle are indeed compatible with each other. Clearly, in this case they are not.
