Ok I've gotten it to work and I've been playing for half an hour and no crash!
I sent the render to D3D. It was a bit stubborn and I had to change that setting three times, which restarted it three times.
Now it works! However, if I change color mode to 32-bit then it says that option is not availble, switching to software rendering. And 16 bit is ok, but its starting to get kind of annoying.
I have the latest drivers installed.

Try to launch the game in Administrator Mode.
Right click it and go to compatibility mode and check run as administrator.
Then try to change the settings again.

I run mine in software mode and 16bit I know its not the prettiest game out there but for its age 16bit and software mode is fine.
