    Ok.

So, I assume that you try to run it in compatibility mode. If not, try this:
Right click in the program, and try to run it in compatibility mode with Win XP; or
Run D2 video test again, and see if it fix; or
Check if your graphics driver is updated; or
Check if your Diablo II is updated (downloading the last patch).

    Try Device Doctor

Let it check your drivers and go for the graphics. :)

So i did that, and it said no updates for graphics... just ethernet, webcam, and audio stuff... i upgraded the audio though, any way...

would it hurt me speed, or anything by taking off windows 7, and putting Vista on my laptop??? that wont hurt my processor or anything right???

Sure you could run Vista on a computer capable of running W7
I just don't think it helps you with your Diablo issue.
That runs here just fine on W7 just as it did on Vista.
(I believe if you don't like W7 you will hate Vista
You might want to check on battlenet how to fix several issues:

Battle.net - English Forums -> Windows Vista/7 and Diablo II

Battle.net - English Forums -> Weird colors in 2d mode

    Good Luck
