Tryed putting the audio down from 192000hz to 44100 hz which worked for dead rising 2 and updated my graphics card but still nothing.

You are not the only one with this problem you are one in hundreds,bioshock has many bugs and im 99% sure is not a windows issue.
I also had the same issue (sorry i cant remember the solution right now,it was months ago)

Edit:I remember 3 things
a)do not block bioshock in firewall during the installation,dont block bioshock in firewall ever.
b)try with the compatibility mode
c)copy paste every time ur game saves in a second hard disk because bioshock very often creates corrupted/damaged saves!!
I found also this:
- First, make sure that you meet the minimum hardware requirements and that you are running the latest drivers for your video card. You know, this is the basic stuff that you need to do for any game issue.
- Next, go to Control Panel, Hardware and Sound, Manage Audio Devices, and select the Recording tab.
- Next, right click the empty space below the installed devices and check Show Disabled Devices.
- The Stereo Mix should appear. Right click on the icon and enable it. Then, click on OK to close the window and then close the Control Panel.
- Next, locate the bioshock.exe file. Mine is located here: "C:\Program Files (x86)\Steam\steamapps\common\bioshock\Builds\Release\Bioshock.exe". Right click on it and select Properties. Select the Compatibility tab and and check "Run this program in compatibility mode for Windows Vista".
- To start the game, double click on the bioshock.exe file.
This is what I did and everything about Bioshock is running great.

A patch sometimes is a good solution,but as you can read here
