The fact that Microsoft attempts to track leaks is proof enough to me that it is not meant to be a free-for-all

But of course they aren't going to do anything about it. They'd rather people pirate their software than use a competitor's product.

If they are tracking them then they are doing something about it aren't they? They wouldn't go through that much trouble to include tracking code for nothing.

PS. have a look at this, especially the last definition. > Definition of 'Escrow'

Sure, they might punish the guy who leaked it, but they don't punish the 100,000 people who downloaded it from bittorrent.

It further proves my point. It's only free if you pirate it.

Not true, there are other ways and means of obtaining the betas. As long as everyone abides by the EULA, using the software is legal.

Sure, they might punish the guy who leaked it, but they don't punish the 100,000 people who downloaded it from bittorrent.
If Microsoft thought everyone was 'pirating' it, beleive me.. they would do something about it against the 100,000 ppl.
It's more about the EULA rather than how it's distributed.

Well that and i highly doubt they care at the moment cause they are just getting even more feedback right now. When it becomes retail and costs money, then they will care.
