Cannot delete locked folders from previous installation with full own

An attempt to update to the Windows 8 preview orphaned a "windows" folder and I cannot get rid of it. I have ownership and full permissions for the folder and all children. There are no corruptions in the file system and I am at a loss! I have tried all NTFS permissions, unlocker, etc. PLEASE HELP!

it is actually named c:\$WINDOWS.~BT and it will not go away, it has 8GB of windows 8 preview files in it.
