    Yes you can

Install on your new drive. Do not give key number. When done, make sure you are happy with the results. Then do a phone activation. Do not give a key number during install and do not check activate automaticaly when online.

Tell the rep, when online that your old hd died and you only have one copy of "Windows in use.

    Activate Windows 7 by Phone

No, you must call and tell them, promise that it will not be used and you will be good to go.

As long as the key does not have OEM in it.
