am i able to format the hard drive using the disk...i dont want to use it to install windows 7

Yes, have a look at this to do a wipe, after you have copied out or made back-ups of the data you need to save to external media, after the clean all finishes type exit 2 times to close the command window and restart the PC.

since i formatted the hard drive no BOOTMGR error
Be sure to wipe the HD using Diskpart Clean All command linked by BFK above, to overwrite any possible boot sector corruption.
Leave the Product Key box blank during install when using Upgrade version on cleaned HD, then after install do the quick registry edit (set a restore point first) given here to activate: Clean Install with a Upgrade Windows 7 Version
