Windows 7: new laptop is truely stuffed up ?

It would be best to stick with the steps 1 and 2 I originally gave you in Clean Reinstall - Factory OEM Windows 7.

Post back results of all steps once you catch them up.

still same thing burned using an external burner this time i dont think its anything to do with the iso or disc.

i cant burn it into a usb tried the windows 7 tool after it completes it sais it couldnt install the boot file or something
and unetbootin is for linux, also im having abit difficulty find the bios update.

If MS Download tool isn't working then use Universal USB Installer.

i just ran the os disc i burned, on my other pc and it was installing perfectly on it.

Waiting for response to the other steps I gave you. Did you reset the BIOS to defaults? What are results of the HD Diagnostics test?

If you can't regain the ability to boot a disk and the HD and RAM test good, then you can move the HD to another laptop to wipe it with Diskpart Clean Command, or try booting free Partition Wizard CD
which will boot itself to Wipe the HD. Then when you return the wiped HD to problem machine it should autostart also the installer to reinstall.

I would also pursue the warranty via the seller to see if you can send back the laptop or at least replace any bad parts.

iv posted the HDD out from the laptop back to the seller for an replacement.
plus iv wiped the disc several times, tried every solution i could just would not fix the problem.
anyways thanks for trying to help me out.

How were you able to wipe the disk? Did you move it to another laptop?

If you truly wipe the disk with Diskpart Clean Command and not format or delete it, then the installer should autostart on the problem machine.

If not, install Win7 in the other machine, see if it will start when moved back without having to first SysPrep to move HD to another computer
