Under the EULA you need to have a previous qualifying Vista or XP to use Windows 7 Upgrade version, although it doesn't have to be installed.
You can clean install the Upgrade over RC by booting the DVD. It will see an OS during bootup to allow Upgrade version key. If not, use one of the workarounds here: http://community.winsupersite.com/bl...he-answer.aspx
