Windows 7 Upgrade Instead of full on New HDD

My HDD died on my vista computer (Custom built) and I would rather use windows 7. can I just buy the windows 7 upgrade disk and be able to forget about vista? I lost my vista disk and stuff some where in my basement and decided it was a sign. or will I need to find my vista disk install it and then upgrade? if the later is true I probably won't bother with 7.

You can clean install Win7 on a blank, formatted disk with an upgrade version.

Clean Install with a Upgrade Windows 7 Version

Remember, if you do not have a valid qualifying previous version of Windows, then you are violating the MS EULA and could get your product key number invalidated by Microsoft. Plus, it is illegal.
