    Proposed law seeks to make retailers financially responsible for data breaches


    The bill, AB 1710, would make retailers responsible for notifying customers of any data breach incident, as well as hold them liable for reimbursing customers' financial damages.

    The bill would require the business that maintains the data to notify affected people within 15 days of the breach. As it now stands, banks and credit card companies are also liable for consumer losses caused by data breaches.

    During a news conference announcing the bill, Assemblyman Roger Dickinson (D-Sacramento), who co-authored the bill along with Assemblyman Bob Wieckowski (D-Fremont), said that consumers have the right to know where their information has been stolen from, as well as have the choice as to whether or not to continue to do business with the source of the compromised data or the breach.

    I see good and bad in this.

    Right now, the banks (who are the ones who really control the world), are making billions. The banks make more mistakes than anyone else. Their careless handling of customers personal details, accounts and transactions should still be levied against them.

    Retail industries who make mistakes should foot the bill of their mistakes.

    I fear what the banks are doing here is yet another move to position themselves to be unaccountable for anything.

    An example. I had a contract with an ISP, which through litigation, I gained a "no penalty exit right". When I cancelled the contract the bank continued to allow them to take money from my bank account. to this day that matter is not resolved. The ISP in question (Dodo), got money they should not have taken, and the bank continues to accrue charges against me for the matter.

    Who should foot that bill? The retailer (Dodo), or the Bank? The ISP is the one who mishandled my information - they knowingly ignored the termination of the contract, and failed to delete the direct debit.

    IMHO, both. The ISP should return the money they took, and the bank should return all the extra charges.
