you will almost certainly be familiar with the controversial case concerning the owners of famous BitTorrent tracking website 'The Pirate Bay', and the Swedish court of appeal. Today it was announcement that the four founders of the site will not be allowed a retrial on the matter, the sentence passed initially being final.

Initial accusations of the judge who presided during the train being biased against the four pirates have been quashed. These accusations came just days after the initial trial in April of this year, stating that the judge presiding over the trial, Thomas Nostrom, behaved in a hostile manner to the defence, due to his affiliations with the Swedish Copyright Association and the Swedish Association for the Protection of Industrial Property.

In response to these allegations the appellate judge, Anders Eka, released the following statement to members of the Swedish media:

"We have reached the conclusion that we do not agree with the conflict of interest claim."

The appellate court's panel of three judges went further to say that the backing of the "principles" of copyright law "cannot be considered bias."

The Pirate Bay administrators, Fredrik Neij, Gottfrid Svartholm Warg and Peter Sunde have been found guilty of facilitating copyright infringement along with Carl Lundström who was convicted of funding the operation, these sentences were drawn in April.

Whilst good for the communities representing the rights of those whose work is copyrighted, this trial has caused a backlash among st the Swedish Youth, resulting with some 40,000+ members of the Swedish Pirate Party backing the defendants. Recently the party have won a seat in the European Parliament.

The Pirate Bay website is still open so what has been achieved apart from giving it massive publicity and handing out ridiculous fines to those involved ?

The judge who presided over the Pirate Bay trial has been forced to deny that his involvement with two pro-copyright organisations constituted a "conflict of interest"

So the judge is biased , over £2,000,000 in fines for supplying a service basically the same as google ? All seems as clear as day now.not hard to work out whats gone on.

Copyright laws in Sweden are very different to ours so it isn't illegal to file share copyrighted material and i do realise that software/media piracy is theft in my country , BUT if music companies in particular used torrents to their advantage i think they would make money from them.( indirectly) Groups/Artists make the majority of their income Via live shows and tours and some merchandising. Its the record companies that make money from album sales. Its about time they realised that Bittorrent can be a friend to them and a great way to advertise .

Digital media is the future.

I have no intention of flaming you, although fact is.. except for Music/Movies most things are not being 'stolen' (unless they have key cracks) as many users like myself end up being forced into the option of pirating software when they break/misplace their existing copy, vendors of those software would be better off offering free copies to those who purchased it.

When I buy software the first thing I do is to make a copy of it prior to installing it on my computer. As of yet there hasn't been a application/program that would not let me copy (back up) it for my own use. I have a 500 Gb HD with all the software purchased in the last five years, and they all install without a problem. I do believe that if you purchased the software you should be able to make a backup of the application. If for some reason you are unable to back it up, then I agree with you and all the others that at this point downloading an application/program is not wrong (especially if the company you bought the application from is not willing to provide you with a backup copy). :)

Linux use torrents to distribute distros, and thats free.Not all torrents are bad.

The pirate bay does not hold any cracks/key gens/films or music files on the servers they use. In basic terms they operate a search engine, exactly the same as Bing. ( you can also get links to pirate software using Bing , if that was your desire)

The people that are to blame are Joe public as they swap illegal files between each other. Dare i say it a good % of people running leaks of W7 used a torrent to get it.

Hollywood dictating the law to other countries is ridiculous (thats what happened in reality) When Video came out industry people were saying " oh no ... the film industry is over" but in reality they made millions in video sales because they adapted.

Im all for companies making money and i certainly don't want to see Artists lose a penny from lost sales. Major company's need to adapt now and use the internet , not try and control it. The Govt in the UK has already turned around and said that they wont try stop people from file sharing and wont force ISP's to control it either.

Try watching a film called " Steal This Film" its on the pirate bay and its in no way breaking any laws downloading it.... its good viewing and very informative. :D

I totally agree, piracy is wrong and if you distribute stolen software and movies etc then you should expect all that is coming to you.

The problem as I see it is they technically did nothing wrong, they didn't distribute any copyright material, all they did was index torrent files that contained no copyright content, if this is illegal why aren't google and yahoo etc up in court?

Also everybody should be entitled to a fair trail and the conflict of interest in this case is beyond belief.

i didn't cry with Napster shut down way back in the day. and i won't cry when TPB goes. these sites don't last forever, so people who use them simply adapt.

anyway, TBP is the last place i'd turn to. there are much better sources out there for people looking for leaked Windows 7 isos or for big archives full of Gutenberg ebooks :P

Idk... is there really a 'moral' obligation pay for something that doesn't exist in a physical sense (data). i dont think so... I personally use TPB on a daily basis (mostly legit), so i wonder, if a company makes, lets say, a game.. the game SELLS 1million copies at release. game costs $50. the company spent 3 mill in development/marketing.
thet're still making $47,000,000.... are they really concerned about the 20-30 thousand they lost to piracy?

It's a load of crap that TPB doesn't get to defend themselves, but they don't have the same law in Sweden or w/e ... so all we can do is watch it unfold, and hope those guys dont get raped in prison.

Eh, sites like this won't ever die, especially in an era where there really are no sensible legal ways to get all a person's favorite shows and movies in a format they want at a reasonable price. I've used tpb quite a bit, but mostly when a product simply isn't being offered to me. I pay for cable and satellite, yet can rarely use them because I'm always on the go. iTunes has some of the shows, but what's a man to do? Do some complicated semi-legal conversions that take way too much effort, or just set a torrent rss up for each new season? And almost every pc I've ever bought I have to use a bootleg copy in order to wipe the drive and install windows without the OEMs crap.

I don't mind paying reasonable prices to a company for a service, but when the service isn't being offered, there's a gap between moral and legal that widens. It's just how business works right now (do you really think all these strictly mp3 players that advertised holding tens of thousands of songs would be so popular otherwise?)

Eventually somebody's gonna offer an unlimited subscription to all access music, movies, and tv for some monthly fee, and they'll be rich. And as for software, it seems more and more that developers are switching to premium subscription services to fund themselves (evernote is a great example, free app on mac/pc/phones, $5/month for premium syncing)

And think of all the 13 yr old kids playing with photoshop and other $600 pro programs to learn. Obviously they aren't going to buy the programs, but it does a lot of good to these companies to have a force of trained adults who are some point can reasonably buy these programs for work.

Piracy will always be wrong. Of course, we won't care about it cause we are not losing anything but the software companies or the music companies always lose tons of cash because of pirates selfish actions. Freedom of the Internet is OK but Piracy is not part of Freedom of the Internet and it's wrong. Of course I do download many programs from it but that is only to test the programs if their trial version is too short. If I like these programs, I consider buying them and that is if I have the money and think it is worth it.
