Considering you're using the stock CPU cooler your temps are fine at idle. I'm running a i7-950 OC to 3.6 (3.8 with turbo mode) using a Noctua CPU cooler and my idle temps avarage 42c.
Bottom line is there's nothing wrong with your temps.
thanks this was my first time building a comp , just was not sure about the temps ps it would probably help if i got the comp out of the cuby hole I got it in

Probably as it would allow for more "breathing" room. To be honest temps are dependent on the environment the processor, and PC is in.
Examples include.....
Room temps
Case/Case design
Fans/Number of fans/size
CPU cooler/Cooler design/fan/fan speed
Thermo paste
CPU itself
Voltage
Motherboard
Plus others. That's why I'm not a fan of the "your temps seem high" (no offense to GeneO) as there are simply too many variables to consider.
Also consider that your CPU is running well within its temp limit of 95c. (as measured by Core Temp/Real Temp using TJ Max).
