One reason why Windows might think its an upgrade, is because in the upgrade installer it detected a version of windows already installed, and then formatted it.

(there was a partition before C: with the OEM Win Vista Setup files, if that makes a difference)

I think it is primarily a AHCI issue. Installing Intel Matrix Storage Manager fixed it for me.
Choose a similar driver depending on your motherboard chipsets and try again.
