I ran a diskpart and performed a clean. I did a format fs=NTFS and then installed from the original 64bit disk.
re the malware / virus check

superantispy 355 tracking cookies nothing else.
cleaned and re ran above nothing found
current status is cleaned and running basically.
cannot install SP 1
Downloaded stand alone thingy and then run downloaded SP1.ISO (7601.17514.101119-1850_Update_Sp_Wave1-GRMSP1.1_DVD from MS) Sp1 I get an error code which is solved by installing the stand alone thingy and then installing SP 1.. round in circles I go.
I think that either its a full fresh reinstall OR live with it. Switching out one of the spare hhd and using that as the C drive might be the next move or just switching over to a SSD.
I dont think this is going to be solved I think theres a basic error with something somewhere on the disk and it defies the odds its a bad install or bad hdd after 14 months.
Unless anyone really wants to keep at this I dont want to waste peoples time and will close this in about 8 hours or so

As someone else said that 7 should have come with SP1 on it so I guess it is an older buy? I did the same thing mate when I bought a pre built and the OEM they sent didn't have the SP1 and it was a pain then.
I still reckon you would be better to boot from a SSD and do your thing with the other drives.
It's also a good idea to download the Microsoft Readiness Tool as it will help with some of the updates too. The others put me onto this when I had heaps of problems with some updates (that is if you haven't got it already) .

We can by pass the non SP1 installing. go here Official Windows 7 SP1 ISO from Digital River « My Digital Life and download the iso file for the exact version of w7 you now have, any other won't work. Save to your desktop to find it easily for the next steps.
Do Step two here Clean Reinstall - Factory OEM Windows 7 and I think you may skip to step 7 and continue.
