Blue screens include: DRIVER_IRQL_NOT_LESS_OR_EQUAL
REFERENCE_BY_POINTER
Reference one had: "STOP: 0x00000018....."
Driver one had: "STOP: 0x000000D1...."
and: "SYMNETS.SYS - Address FFFFF8802E08360......."
64 bit OEM pre-installed have reinstalled from partition
1 month old pc

Let's have a look at the ram, normally I would ask you to follow the site's bsod posting instructions but it seems that would be problematic here.
RAM - Test with Memtest86+ <--- link
for the moment follow that link and allow the test to run for 5 to 7 passes.
(unless it spits out errors right away then you know it's a ram issue)

In addition to that RAM test, I also suggest a hard drive test; use SeaTools for DOS.

its spitting out a TON of errors, maybe as many errors as it does scans.

If you are talking about the memtest, the new ram is bad.
I would return it immediately.

i rebooted and it wouldnt start up, so i shut it down. then turned it back on, it said windows couldnt start and it would check for errors. it repaired them and finally started up. I am now running memtest again and it hasnt been spitting out errors like it did the first time.

That makes absolutely no sense...
What windows is doing is completely unrelated to how the memory reports in memtest.

What exactly are you trying to say? I didn't get much from your post.
Also, why is everyone posting so much pointless white space along with your posts?

Memtest finished its first pass with no errors. Going to goto bed and let it run overnight. I can post the results tomorrow.

The signature starts at the bottom of the user info (badges, etc), hence the white space.
I suggest you backup your data, replace the drive, and do a clean install of Windows.
EDIT: seeing as the computer is new, return to the computer to the place you got it, or send it in for repair.
