Seeming random crashes

    Where did you buy it? I'm only asking because you have an HP Windows 7 OEM copy installed, and that's only available directly from HP.

    I got it from one of those shady websites could not find a reliable download for premium

    That's your problem, then. Sorry, but you'll need to purchase a legit copy, because that key is probably blacklisted.

    Well i still have the home premium key on the underside of my computer would that work?

    Yes, that will work. You can download a legit copy of Windows 7 from here:

    Download Windows 7 ISO (Official 32-bit and 64-bit Direct Download Links) « My Digital Life

    Download the version that corresponds to the key on your laptop, then use that key to activate Windows.

    Ok could my crash problem be related to that?
    (I am guessing though that installing a fresh copy would fix that)

    A hacked version of Windows could cause a lot of problems, but I have no idea if the two are related. However, you need to fix the underlying problem first - reinstall Windows and use the key that came with the computer.

    When I install Premium do I have to backup or will see it as an upgrade

    You have Ultimate installed - you can't "upgrade" to Home Premium. You need to do a clean install.
