Yes it seemed so. But even if the phone is "saddled" so to speak, using a hands free kit can still get you stopped and warned (At least it can over here.) It happened to a friend of mine while I was with him. Anyway, I'm not well versed in international laws, so I can't say where else does this.

Well first it was mounted to a dash mount suctioned to the windshield. Second I wasn't using it as a phone. It was just sitting there recording video. It can't be used as both at the same time. As I mentioned from an earlier post towards the end of the video you see me in front of the car. Plus CHP didn't hand out any citations since no one was injured. Hopefully no one claims any injury. Actually I believe the officer who took the report passed me by earlier, but that part isn't shown since I edited the video to get straight to the accident.
Plus in CA I believe hands free is permitted you just can't really be holding your phone and driving. Plus I can prove I wasn't on the phone by checking my phone call records or texting. None of that happened on the phone during my commute.
