    Need advice on what to do about income tax preparer


    I turned in my 1099s in mid-February to the tax preparer I've been using for years. It is now early June and I still have not received my completed tax return from him, (a self-employed CPA who works out of an office in his home). I sent him several emails and received responses to the effect that he is working hard to accommodate all his clients so please be patient.

    In early April I actually went back to his office and asked him about my return. He said then that since I was due a refund, there was virtually no deadline - deadlines were for people that had to pay additional taxes, but that he had filed for an extension. This satisfied me temporarily, but now I am getting really concerned. I doubt any more emails or visits to his home would produce any different results.

    I am such a meek person that I am not really good at confrontation or effective argumentation and I certainly do not want to aggravate him when he has all my records. I have managed to obtain replacement 1099s for all but one bank. I don't know what would happen now if I hired another person to file without informing him and then he goes ahead. Any suggestions on what to do?

    Would you go to a mechanic for medical advice? Or a dentist for a hangnail? You need to talk to a lawyer.

    The preparer is correct IF you are due a refund. You do not need to file on time in that case.
    My daughter went over five years without filing because she was overseas and knew she was due refunds for each year. Still, he must have looked at your situation to know you're due a refund. Let him know that you are very concerned. Ask to see the extention request.
    You would be covered if either you are due a refund or he filed an extention request.

    I contacted several and summarized the situation. However all the local ones say that my problem is not within their field of law. Most locally just do wills or property searches.
