What constitutes as LIVE? when using these? My Brother-in law is looking at getting this but since it says he can not use in in a production environment he is scared to use it since he runs the business out of his home office (5 users)

Would this be safe for him to use for live testing of his servers?

Ok lets not kid ourselves guys. Although Microsoft says technet products is for testing only..Being that these are full version software without any limitation on the software itself, most people install them on thier production machines. Just because Microsoft says one thing doesn't always mean people actually do it. Especially if its full complete versions thats available for download via a technet subscription. I know that when Windows 7 RTM gets released on technet..It will go on my production machine. Just keepin it real folks.

Thats fine for you as an individual but if you run any kind of business and you get audited what happens?

As far as I know his chances of getting audited is smaller than being audited by the IRS. MS is going after the big corp licenses where they can catch hundreds of illegal licenses.

Depending on how you use it, it can be more than worth the money, especially with one of the discounts available.
You can install everything available on every device you own, including devices at home. You get as many keys as you need; 10 to start but more if you need them (after a call to MS).
Activations are permanent and don't expire with your subscription.
You should read the fine print
    TechNet Plus Subscriptions License Terms
    and the FAQs
TechNet Plus Blog | IT Professional Community | Newsgroup Support

The one clause you need to pay attention to is this one:
"You may not use it in a live operating environment, a staging environment, or with data that has not been sufficiently backed up."

MS has specific definitions of "live operating" and "staging" environments that you might want to review.
