ok final solution to the problem!

I flashed my card to the new settings and also made sure that the boot up clocks are the same as the clocks used when into windows.

I used Nibitor 5.2 and nvflash boot cd to permanently clock my card to 525/760 from 520/750 and uninstalled rivatuner. I did some tests to try and replicate the problem but it seems the problem is gone for good. My card is out of warranty so I didnt worry about that... I just dont like middle solutions unless I have to live with them... it seems that this time this was not the case

I hope this helps more people in the future.

NOTE: I also changed the boot up clocks because I had the feeling that the problem also occurred when the driver tried to change to the windows clocks. So the card is using the same clocks all the time.
Cool Im going to have to try this out later on, thanks for going the extra step man :).
Do you have the links where I can find both of those programs? Thanks

here is another forum's procedure who have the credit for flashing the card.

(I hope Im allowed to post this - of not please delete)

NOTE: The problem does not occur at all... not even at the late boot stage exactly before getting into windows. Is seems 100% stable 2 days later.

Replied to another ancient msg I see, well my input for archives!

If regular video card troublshooting has failed....

So it's probably a heat issue, I'd get a third party heatsink/fan with the good stuff for paste. Arctic Silver 5!
I did this with my old 7950GT and it lowered the temp, significantly.

This is the heatsink I put on that and I would recommend it, but read instructions carefully!
Vantec IceBerq 6 CCB-A6C Premium VGA Cooling Kit (Retail)

I'd buy some cleaner for CPU/heatsinks also to get rid of old paste, the video card makers cut corners on that and you want the good stuff. 2 bottles one for removal of old paste, one for cleaning after that, under $10 for both, the new paste, around $6 and you don't use much, enough for thin coverage, I put it on bare handed and wash with Lava afterward.

Run GPU-Z before and after and marvel in the results!
