the seller has contacted me and given me a full refund aswell as offering expert technical help to sort it out if i wanted.
To be fair to the chap he was very honest and helpful and can't complain about him. Reading his reveiws on play.com it seems this is the first time anything like this has happened so i guess this is just one of those things.

Check the prices from Dabs.com and scan.co.uk - I usually find them to be cheapest.

one more question.....i see there are oem versions with sp1 that are around £130 are these ones ok? or am i better off going for the full retail boxed ones that are around £160?? if i'm paying more for just a box then i'm not bothered about that!!
The biggest difference between OEM licenses and Retail ones is that an OEM license is locked forever to the first motherboard on which it is activated. If the motherboard dies 5 minutes later, MS would be within their rights to refuse to allow activation on a new one.
Also, the OEM System Builder license (to which you agree by opening the pack) requires that the installation is made using the OPK, for sale of the installed system to a third party.
You're very unlikely to need all the bells and whistles in Ultimate - Professional haas pretty much everything except Bitlocker and multiple Language support.

If you want multi-language support, then you need the Ultimate version.
I, and many of the people working on this forum, use ultimate although you can get by with less.
Do NOT buy over eBay. Buy from a reputable store where you can see the packaging. You will pay more,but that's because the version is legal.
Legal is the key word. Do you want the same kettle of fish you had?
Now to save money: Use the OEM version. If I recollect correctly MS lost a suit against the EU and must accept the use of the OEM version by individuals just like with the other versions. This suit originated in germany and went all of the way. MS does not like to speak of this.
Another solution is to use an UPGRADE version which is every bit as full as a FULL version, but is cheaper. Now I'm not going to get into a long discussion with anyone on these matters but I researched the matter, Paul Thurott researched and published the how, Ed Botts did the same.
We have a tutorial on using an upgrade version and performing a virgin install.
You will have people say, but...etc. believe me you will be OK.
