new hard drive have key but no original OS disc

I have a Samsung Laptop that had Windows Home Premium OEM. Did not come with a copy of Windows but I have the key. I do not have a recovery disc. I am in México right now. My HD crashed and a local computer store is doing the repair. Normally they just install their own Windows Pro 7( probably using it illegally!). But it is in Spanish! I know how to change almost everything to English but some things never change. A real pain! I do have an upgrade disc of Windows 7 that I purchased a long time ago to upgrade another computer from Vista. Can we just install this upgrade to my laptop but use the key that is on the laptop? Or would I have to use the upgrade key and call Microsoft? Thanks

Link from M$ valid for 24 hours
    Win 7 HP SP1 - OEM English
    32 bits https://software-download.microsoft....ec96c89567dc5c
    64 bits https://software-download.microsoft....82d3a5d51f903f

Use the laptop COA key to install / activate.

You can use the Upgrade disk but it's against the license to install in two computers.

I understand your concerns about licensing however I think I am legal. Both computers had licensed versions of Windows 7. The Desktop came with Vista and I paid for the upgrade. I have that disc. The Laptop came with Windows 7 installed. I do not have the disc or the recovery disc. I am no tech but in both cases I would be using the legal keys. It is my understanding that you load the os from the disc but use the key for that computer. Is that correct? The laptop will have a new hard drive so that installation should go well.. The desktop has that bootleg version of Windows 7 Pro. Can I just install over that OS? Or? Downloading would be difficult as my Tech is 65 miles away and she does not speak much English. I get by in Spanish! How do you download onto a virgin drive with no existing OS? Thanks

Can't you download the iso file to the computer you're using to write in this forum?

    You have two choices:
    - Download the iso from the link I provided. If the laptop has more than 4G of memory install the 64 bits version, otherwise the 32 bits. Use the COA key on the laptop label to activate.
    - Do a clean install using the upgrade disk you have. Be sure you delete ALL partitions on the disk. Use the key that came with the disk. Clean Install Windows 7 - Windows 7 Help Forums

For the updates MS releases SP2 for Windows 7 - Windows 7 Help Forums

What version is the upgrade license you have (Home, HP, Pro...)? As it is an old disk it probably isn't SP1.
