Dont think so, I got plenty of download usage left.
You might be allowed to download say, 10GB p/day, but you won't necessarily get the same download speed all day, at peak times ISP's typically choke everyones connection in the interest of EVERYONE'S speed.
Does this sound right or is it more a NIC problem?
In australia its differnt I get 50Gb per month. and if i exceed that speed gets throttled down to 512Kb/s

NIC - Network Interface card (your wireless card probably).
Where and what are you trying to download? You'll not always get optimum speeds from websites, Adobe for example takes me around 25minutes to download their flash plugin (2MB or so), yet MS Office from the MS website took around 10 minutes to download (750MB).
Also, although Speedtest.net is relatively accurate, i have tested my connection half a dozen times consecutively all with various results (some not so good!).
If the speed is consistently poor, contact your ISP, they'll be able to tell you if it's a ISP issue, your router or Windows.
Probably the modem/router restart if you did it.
Or the driver installed without software? Works for me.
Okay, thanks a lot guys! Hopefully I wont be running into any more trouble.
Great new prob... the computer goes into sleep when I'm not using for example when I leave it downloading a file or something.. and plus internet speed is it at 40Kb/s

You can adjust the power settings in the control panel, from there you can prevent the laptop from sleeping.
Apart from making sure that your network card is up to date with drivers etc. I unfortunately have no suggestions for your poor speeds. I suggest taking to your ISP.
