Do you have a way to back up your files as this will make it a lot easier to correctly delete the Win7 partition during reinstall. You can then create your partitions as you wish during reinstall using Custom>Drive Options as shown in Clean Install Windows 7.

I believe you are asking if you can avoid activation to a small Win7 partition while keeping the other Win7 or removing it's Windows folder. This is not possible as the OS you are running must be activated. So it's best to wipe the old OS.

If however you cannot delete the old OS correctly, I gave you the options earlier to shift the data into a data partition. If you want to try to delete the Windows folder you can also do that. But if it's not done before you install the new Win7 to its partition, it will indeed configure a Dual Boot with the old OS.
