Windows update cannot update because........I've tried everything

When I go into Windows update there is a RED X on windows update even though it is set to automatic and turned on. When I click check for updates I get the message windows update cannot currently search for updates because the service is not running. you may need to restart your computer. I have searched many forums about this and have tried everything. This is a Windows 7 ultimate install that is only a week old
(tried twice). I have turned off Windows update, then deleted the "Software development" folder in C:Windows, and then restarted the computer and windows update to no avail. I have checked to see if B.I.T.S is running and it is. I have tried running the FixIt program an nothing.... Task manager says that windows update is running.
I have no idea what to do next. Any help would be much appreciated.

    Thanks

    Both are started?

    Click on the Start button
    in the Search box, type
    SERVICES.MSC
    hit the Enter key
Accept any UAC prompt that appears, and in the Services control panel, look for the following

    Background Intelligent Transfer Service -
    double-click on it
Check the Startup type - ensure that it is set to 'Automatic (Delayed Start),
    and OK out

    Windows Update
    double-click on it
Check the Startup type - ensure that it is set to 'Automatic (Delayed Start),
    and OK out

Now try starting the Windows Update service and the BITS - if you get errors, post the EXACT error message.

I already did all that, and there are no errors except the message "Windows update cannot currently check for updates because the service is not running, you may need to restart your computer." Both BITWS and Windows are set to Automatic (delayed) and both are running.
    I ran the MGADiag Report

Your installation of Windows 7 Ultimate is counterfeit.
You have an HP Pavilion manufactured almost a year before Windows 7 was released, but the machine claims to have a windows 7 SLIC table.
For which version and edition of Windows is it licensed, according to the COA sticker on the case??
With what did you do the upgrade to Windows 7 Ultimate?? - where did you get this from?

I got the disk and key from a guy on Craigslist who said he never installed it, so I thought it was good to go. Is there anyway to go back to Vista? My old hard drive crashed and it couldn't run my vista backup disks because the new hard drive is Advanced Format so nothing worked... or can I buy the Windows 8 upgrade instead? I dont want to have this problem and I want genuine software.

    Thanks for your help guys

Craigslist is as bad as eBay for software.
I'd guess that 90% of the Windows software at both sites is counterfeit.
Windows 8 is probably your cheapest option at present.

If you have this problem and recently swapped out your hard disk as I had, the link below solved it for me.
