You are correct they could appeal if they lost in U.S. Federal Count. In U.S. small claims court, neither side can appeal. Sometimes the defendant can try to switch jurisdictions to Federal court, sometime that works and sometimes it doesn't. I am not a lawyer either. It all from what I either read or heard.

Those of you who have set the Control Panel option to "Download Updates but let me choose whether to install them", how do you know if it is a Win 10 Update. Doesn't it only have an Update Number?

    1. You look at the KB number and if it's on the list .... (there are many lists :), read last 10 pages) .... don't check it, hide it.

But KB3035583 seems to be particularly nasty. After hiding it when it 1st came out it repopped in the last few days despite being hidden. I had about 23 updates there waiting for me to go thru the list and decide to hide / install and there it was.

So I hid it. I usually install them in bunches rather than all at once so did the security updates, then .net or whatever. On the optionals I had hid 5553 and another one, thing after the restart I would just select all and do the remaining optionals that had nothing to do with Win10.

Restarted and, just selected all the remaining and restarted. Imagine my dismay when the Win10 icon was sitting there in my system tray. Even tho I had just hidden it for the second time, 50 seconds before, after rebooting it was back . Weirder still was that GWX Control panel didn't give the expected warning (in monitoring mode) but when I opened it, it did say that the icon and app were there.

So I uninstalled it, rebooted, and rescanned; it's gone.... for now.

    2. The Control Panel option to "Download Updates but let me choose whether to install them" has a habit of changing itself.

Does this mean that programs like O&O's ShutUp10 don't really work even though they appear to?

I'm not implying that O&O and others are being deceitful, of course. What I'm wondering is perhaps there's 2 (or more) sets of 'data recording' mechanisms in Windows 10 - the ones that MS expect people to find and disable and another one that's so deeply hidden inside the operating system that only MS know where it is.

But, I'm sure the makers of ShutUp10 and other similar programs do thorough testing of their programs to check what they are blocking in Windows 10 (or at least appear to be - with MS you never know what's going on 'behind the scenes' sometimes).
I would say yes ... that is no, they don't really work :)

I base this on my understanding that Shutup10 merely provides a convenient interface to turn off all the settings that MS hid as if it was a scavenger hunt of some sort and peeps would enjoy it. If the settings is not able to be change, scripting the action won't help.

You can only hide a version of an update. New versions will be offered - even if you have hidden old/past versions. This is why some of us must rely on registry settings to prevent the W10 OS from installing.

I am trying to decide if I should install GMX Control Panel. Is it really worth my time and effort to do it?

It is not much effort to install that tool.

You can enable the monitor mode and let the tool send info back to the tool's creator. It would be nice to confirm that something is changing some registry settings. If that is really happening, then it would be nice to know what apps do that. There are some antivirus apps that force Windows Update to use the Automatic download/install option... but I see no reason for an AV app to toggle the various "do not install W10" settings.

It takes all of 30 seconds to download it and run it. It's tiny.

Choose "download Stand-alone" at the right hand side of this link:

    Ultimate Outsider - Software Downloads

Then just poke the downloaded exe file to run it--no installation required.

The developer updates it regularly, so go back to the link periodically to get the most recent version.

He said on Dec 15 that he was halfway through a major update, so be sure to get that. The newest currently available version is from late November.

Well you also have to uncheck Give me recommended updates the same way as important ones too that way recommended and optional updates are separated from real important ones,

Every update if you click on it will show a More information link on the right column
Open it and read it is the best and only way to know what it addresses
If no definition exists skip it until one does appear

Usually it will state win-10 or upgrading to the latest os in the description that is how you know
    If any doubts ask

OK guys, I've got GWX now. This is how the Control Panel looks. Is everything in good shape?

Depends it reads to me that you have win-10 folders or at least 1 so if you want win-10 you're in good shape :)
Ultimate Outsider: Using GWX Control Panel (formerly GWX Stopper) to Permanently Remove the 'Get Windows 10' Icon
The text field in the center of the window lists the specific kinds of Windows 10-related settings or files the program discovered. If you would like to permanently remove the 'Get Windows 10' icon from the system tray, click Disable 'Get Windows 10' App. This will remove the icon and prevent it from appearing without your consent again.

    Note 1
If one or more of the buttons is disabled, please see the GWX Control Panel FAQ for a detailed explanation of the user interface.

    Note 2
If you ever see a dialog box that says "Do you want to allow the following program to make changes to this computer?" please click Yes. (The program can't continue unless you do.) If you'd like to know why this dialog box appears, please see the GWX Control Panel FAQ.
If you discover that your Windows Update control panel has changed so that it now says "Upgrade to Windows 10" and automatically selects the optional "Upgrade to Windows 10" update for installation, you can now stop this behavior by clicking Disable Operating System Upgrades in Windows Update in GWX Control Panel.
