mininova.org limits it's activities.....

So if you live in the states then downloading on air tv shows is illegal? I read that there were no laws on that yet since it was free trade to record to VHS or DVD and share as well as DVR and TiVO
Is illegal no matter where you live. But some countries has different rules regarding piracy. For example in Switzerland (Europe) you may download as much legal and illegal content as you wish to. BUT it is illegal to upload illegal content.

Thats the reason why Rapidshare is hosted and administrated from Switzerland.

With a site as big as twitter, it's almost impossible to get rid of all bad stuff.

yea i know but they on a daily bases on the same twitter page have new torrents all the time and its in San Fransisco. Seems like The law in america would be all over that like they were the mp3 sharing systems in the days of old.

Hi all
We sometimes get sucked into "whats Legal" and whats "Illegal".

Things change and just because something is "Illegal" at one date doesn't mean that it's always illegal.

Until recently having Sex with someone not of your own race was deemed "Illegal" in a certain very well known country to say nothing of "same sex" activities --still highly illegal in many countries today -- and even in "The Land of the Free" African Americans had to sit at the back of buses.

Other countries had rules on Banning the formation of Trades Unions and forbade women to vote etc etc.

The old adage "It's against the Law" really needs very careful interpretation.

If we really go strictly with the letter of the law 2 HUGE firms would not only be out of business but their founders might be doing serious Jail time --- Microsoft and SAP.

Both organisations built their base product up over stuff ex employees had with them when they left IBM etc. -- and really we are actually a LOT better off with these 2 organisations than without them.

Don't forget also -- The Gates foundation is probably the biggest donor to charities in the entire world.

So who really can say that Piracy is always bad.

What about the USA's Nuclear program --half that was "filched" from other countries .

It's just that P2P organisations are easier to track down than say closing the Mossad or CIA down. P2P at least do their stuff openly.

I don't condone overt stealing of copyright but if the same vigour was used to prosecute the CIA and the Mossad as a few people running Mininova then I might have more sympathy.

Product producers should beef up their security rather than attempting to fill jails with teenage music downloaders .

Anyway "The Ship" is still broadcasting loud and clear at this moment.

I don't condone a lot of the activity but biased judges, lickspittle and kangaroo courts and overpaid lawyers get my goat even more.

As a small country we even had the UK using Anti-terror legislation against some of the heads of the banks which went bust --in no measure due to a lot of UK local authorities using our banks as off shore casinos with their taxpayers money --and if you play Casino you sometimes lose - you can't use "anti -terrorist" legislation just because you lost a bet at a Casino even though I'm sure many would love to).

Don't Lawyers make you want to ...... reader can fill in.

The point of this post is to say that one shouldn't necessarily stop doing something just because it's deemed "illegal" - and many of the freedoms enjoyed by people today were won by people protesting and breaking obviously unjust laws at the time - often at severe penalties to themselves such as jail and worse.

Cheers
jimbo

...and this is were we see the grey line...

There are two types of folks who pirate...the ones who can afford the software but feel that they shouldn't have to pay and/or feel that the software companies owe them the software...and the ones that can't afford the software but they have a need/desire for said software...

Is it wrong to steal? Yes...is it wrong to charge overbearing prices for some software (many companies do this...no one can argue this point...)Yes...

What caused software to get so high? The pirates or corporate greed...which came first...the chicken or the egg?

I hate that metaphor. It was the egg. After all, the thing that laid the egg was not quite a chicken, it was the chickens closest ancestor that laid the slightly mutated egg that we know as a chicken.

Anyways, I always wanted a good reason to say that.

In this case, Corporate Greed (yes, it is capitalized) is the egg, pirating the chicken.

As long as there are corporations, there will be piracy. The way they set all of this up, it just leads to piracy.
Look at it this way: a dollar a song is not too bad right?
What if you want to buy 1000 songs.....? Ouch...

Depending on your beliefs...it is indeed the egg

That metaphor fits perfectly here (whether you liked it or not...)...no one has a concrete answer as to which was the true cause of mass piracy. Corporate Greed or Consumer Greed?

If I were to take a guess the greed would be split 30-70. Seventy percent for the pirates and thirty percent for the corporations.

The one thing we forget is the cost to produce a product; companies have overhead, and in some cases it is quite a bit more than some think. Pirates do not take into consideration what a company goes through to put out a product. Nor do they care it is all about getting what they can without thought of payment.

The argument that someone doesn't make enough money qualifies them to pirate software is unwarranted. Just because a song is $1.00 and you want one-thousand is not a good debate tactic especially considering the songs can be purchased over time. How many people really are looking for a thousand songs at any given time.

This is a debate that can never be won in the forum of debates. It can only be won by establishing laws and guidelines then enforcing those laws. And, those who choose to break these laws need to understand without argument that they will be punished.

After piratebay mininova is the target !!! Next what ?

Isoh***? Probably. This is sad. They take everyone for banks with unlimited funds where we have to pay 20$ for an artist's album where there is only ONE good song. This is rediculous.
You can download one good song 99cents from Amazon.com or Rhapsody.

Well that's the point isn't it - they suffered severe penalties. Without such sanctions there would be anarchy. Avoiding illegal behaviour is one's democratic duty, and it's only when what is deemed illegal seems to be at odds with democracy that we have a moral question to answer - should we break the law for the greater good? It's difficult to see how nicking stuff via P2P is defensible in terms of protecting democratic principles...

Much as I disagree with the idiots d/l ing tons of movies and songs, there is a severe danger to personal liberty here.

Laws only have relevance if the population supports them .

If the population makes it clear they will not put up with it - it will be repealed.

Unfortunately, too many of us just shrug our shoulders and mutter, many more are completely unaware of what is going on.

We are sleepwalking into an Orwellian hell.

Hi all

Thankgoodness some people DO fileshare -- think of many exposures of crimes in high places -- without journalists often at severe risk to themselves getting hold of "sensitive" material we could at times be very much worse off.

P2P per se isn't illegal and even if it were I can see cases where it could be used

For example if I buy a Movie for playing on a DVD player on a laptop and I'm in Europe - why should I have to put up with the B/S saying I can't play that movie whilst I'm visiting the US -- what's a laptop for -- MOBILE computing of course.

So I for one don't treat "bypassing regional encoding" for DVD's THAT I'VE PAID for a crime even if I have to get the cracks from "The Ship" or elsewhere.

Cheers
jimbo
