I didn't change anything and on my windows 8 its coming on the front.
So far i didn't find any option to set if to make it on the back or on the front.

Very strange. The behavior yesterday was as I told in my post with screenshot, you can see yourself that Driver Verifier window is hidden under the tool window.
Today, both machines I tested it yesterday behave normally, Driver Verifier window in front of tool window as it should. Yesterday it was hidden behind the tool window, today I cannot place it behind the tool window at all.
Only difference today is that I have rebooted both machines.

Strange i tried to make the driver verifier to be in fornt each time you launch it.
You will have to make cancel\exit the driver verifier it to return to the program window but i think i could make it to be in the front each time you launch it.
