Solved install new bios

i noticed there were some comments in the bios notes about >4gb disk issues and also "Addressed IDE-R issue in ATA and AHCI mode"

it was >4gb ram giving strange issues with disks....so i was doubly confusing!! have edited the post now so it makes more sense.
