Install of Win 7

I am looking to install win 7 ultimate over my current Vista Home premium. But sadly you cannot upgrade if you have two different versions.

If i Install Win 7 Ultimate over my current partition on Vista Home Premium will it remove all the programs/document within in? (what im not looking to do)

That's not correct.

Vista Home Premium to Windows 7 Ultimate is one of the few upgrade-in-place paths that is supported, as long as you're staying in 32 bit or 64 bit:
