hello. Simply put...

i have a Samsung spinpoint F1 1TB 7200 sata 2 transfering 40 GB's to a Western Digital 3TB Green Caviar sata 3 5200.

i dont believe i have set anything to do with sata transfer rates.

its taking 10+ minutes to complete the 40 GB data transfer.

Is this normal? if it is not. What is Wrong? and is there a way to fix it?

Thank you for your time and patience.

That works out to about 68 MB/sec and I'd call that's pretty good for a real-world transfer on spinning drives.

We see all the claims. SATA 2.0 can go at 375 MB/sec. But those are theoretical maximums. In an actual working PC there are a lot of other factors that affect your actual transfer speed.

One of the major factors right off the top is just how fragmented the file(s) you are transferring are.

That's sounds about right.
I just transferred 18 GB from my Samsung F3 drive to the desktop and it took about 8 minutes.

It's looks fine. You can't go by Explorer transfer time, which can be meaningless.
As already said, fragmentation can affect transfer rates. So can number of files.
Transferring between Cav Black 7200 rpm's, I typically get max 123 mb/s, but that's always a short burst. Average is about 57 mb/s. Average write queue length is 3, so the write side is bottlenecking. I'm surprised you get the rate you are, writing to a 5200 rpm drive. I expect it's big files.
Try using a stop watch and dividing to get your overall transfer tate.
Anything around 60 mb/s is probably good.
