True but Im betting if Microsoft or someone else made that claim then they couldn't ignore it for fear of double standards of regulation :huh:

The claim Opera made to the EU was about IE on Windows being a monopoly and that IE breaks anti-trust regulation, the exact same claim can be made about Safari on Apple and Konqueror/Firefox on Linux... I believe Microsoft haven't made that claim yet because they haven't been fined and the matter has yet been finalized... I bet once it has and that ballot is included with Windows then I bet Microsoft will make that claim against Safari/Konqueror

I sure hope so...it is time for things to even up (no offence to Linux/Apple fans...). This whole situation is dis-tasteful though...at its conclusion (if it ever does conclude) is software makers that are extremely restricted on how they produce their product(s) and the EU becoming a very wealthy commission...

MS can't because in order to be worthy of anti-trust behaviour you must qualify as having a predominant marketshare.
Predominant has been determined by the EU to mean: more then 30%

Since none of above mentioned qualifies they can't be sanctioned by the EU.

my fingers have typed the following so many times i can do it blindfolded suspended upside down:

All fines levied by the EU are redistributed to the members per ratio of their contribution to the EU budget.

The costs for making the case comes out of the EU budget.

For every case the EU makes and wins they lose on their budget.

The budget is fixed yearly and isn't allowed to be stretched. Spending money on courtcases means that other sectors get to spend less.

The EU has no interest financially in pursuing white collar criminals such as MS.

Yes but your thinking about the US vs Microsoft cases back in the 90's...

This is different because Opera's complaint centered about IE itself being anti-trust on Windows because of its 80% market share not the Windows marketshare itself (+95%) ...

Thats why this claim that Opera made can also be made about Safari on Apple because it has more than 90% market share on OSX and the same about Konqueror on Linux because it also has more than 90% market share being distributed on nearly all KDE based Linux distributions.

The EU can sanction them because there not looking at the market share of the operating system, they are looking at the market share of the browser on that operating system
