One of the things they asked for was a new computer which is BS. I think we all know that a bad upgrade won't damage hardware. And they said they never heard of Windows 10. That's kind of hard to believe. It's been all over the internet, on our local news a few times, plus all of the GWX pop ups? Give me a break. Just with all the pop ups, not ever hearing of it is pretty impossible. That doesn't make what Microsoft did right, but there are legitimate grounds to sue them on. Why make stuff up?

It is quite conceivable the plaintiff did not know about Win 10. The unwanted upgrade happened shortly after Win 10 first came out. There was little about Win 10 in most news outlets back then and most people record their TV shows, then fast forward through any commercials so they would have missed the moronic song and dance Win 10 commercials. This is assuming the plaintiff in this case even watched TV. I know I'm reading more and watching TV less even though there are far more channels to watch because the programming has become so bad.

We know that a bad upgrade is highly unlikely to damage a computer but most people do not, including judges and juries. Keep in mind that replacing the computer may have been less expensive than the labor needed to reinstall the OS and programs, especially since finding competent repair services can be difficult in many places.

IIRC, what was happening was that W10 OS was putting HDDs to sleep, but since not all motherboards had the wakeup command (in their BIOS) the machines couldn't restart.

You could use a Linux Distro Terminal command (hdparm) to reset the HDD's Sleep command.
gregrocker had that issue and I posted some instructions for him (on TenForums, around December 2014).

No real loss to me it was just an irritation mostly and a wake up call that anything can happen to hardware when testing betaware os's

Probably my bad the hdd was out of my laptop after I replaced it with a ssd and was in a desktop to use win-10 on :/

I'm still hoping that when all is done we the customers end up with a W-10 that we want or need. I still believe that all Microsoft has to do is fix W-10 and me and a billion plus other customers will just buy W-10 and learn how to use and enjoy W-10.

Make products your customer want and price it correctly and they will buy it. No need for trickery of any kind.

Just like it used to be 10-15 years ago. MS did not have to try and "sell" me on anything.

When Windows 2000 came out and I installed it for the first time - you could "feel" you had a winner. There was nothing to complain about.

Same thing for Win 7 - MS did not have to sabotage my Windows Vista install to get me to move to Win 7. It was a slam dunk (and no-brainer) at first release.

But as a MS customer for 20 years now - I will never ever forget the ass-hat way they tried to shimmy Win 10 onto all our working (win 7) systems. Their arrogance and blatant disregard for allowing a user to make a choice has tainted my view of this company permanently.

I understand why they tried to ram Win 10 down our throats - but the reality is - a year ago - it was crap. Not even close to being ready for prime time. The Anniversary Edition may be slightly better - but for me the trust is gone and I feel like I need to try my best now to NOT to help them succeed by ensuring Windows 7 goes to the limit (2020) on all our hardware.

Not sure if/when I will ever allow Windows 10 into the mix here - because frankly - I do not see the point. After a full year of mainly lame press on the OS - coupled with all the hassle factor/broken trust/anger etc etc of the GWX debacle - I simply cannot justify any single reason to install Win 10 now - or in the future.

So that just leaves us W7 users WHERE?? will we get our old service status or are we gonna stay on the backburner.
Hopefully better as they made compatible W7 comps "phone" MS every couple of hours to see if we had accepted the upgrade

Software can kill hardware stone dead. That is a fact. A program can run and reset options in an eeprom and then the unit will not fire up. This has happened on TV sets with faulty encoded close captioning. There is no recovery except to replace the eeprom and hope the customer does not have a copy of the show with the corrupted captioning. There are many other issues I could mention but I might get sued. Bad software can run a poorly designed laptop at temperatures higher than the unit should see. Eventually something gives up. Sometimes its the fan, sometimes the CPU or Power Supply.

As much as I distain mass tort suits (they are a racket; the lawyers are the only ones who get any real money from them), I would love to see them happen here since they would be well publicized and it may drive the point home to MS that their actions are not acceptable. It might even cause a managerial shakeup at MS, although that may not be a good thing (we went from Gates to Ballsmore to Nutella; the next jerk could be worse).

Maybe I need to read up more on the US anti trust laws given the publicized MS acquisition intentions. Companies like Bell telecommunications were broken up on this basis. I probably couldn't be bothered though along with your choice of the new US President - the problem is it has international impacts.
