missing 44gb of my hdd

OK so the old HDD crashed and got myself a Caviar Black 640.. Today (continuing my efforts to solve my sata/achi issues) I saw that the hdd has some 44GB missing??

As you'll see in the attached pic, when in "My Computer" the hdd appears to be 596GB.. BUT in its properties.. we see its true value (640)..

Any ideas??

OK my wrong, just noticed that in the properties the 640 is bytes..

Does anyone know if the "formula" is different in XP, cause as I recall, while installing XP this afternoon it recognized 610GB (during the selection of which drive to install) which would mean that its divided twice..

I have no clue where you get "devided twice" from. The formula is the same. 7 usually creates a "system reserve" partition and most hDD come with extra sectors that are used when some go bad, which XP might be seeing. You can read more about bad sectors and the extra sectors here:
