Touchpad fails to work when clicked slightly harder.

Bought a laptop yesterday formatted it and just installed a fresh windows 7 pro on it. Model is Dell E6220 (Mid 2011) got all the drivers, they're all up to date and nothing is missing. My problem could be a hardware one but I hope it's isn't so. Touchpad works really oddly, before all the drivers were installed it would freeze up for few seconds and try to catch up with all the moves and clicks I've done, closing/opening/dragging/highlighting etc. After driver installation it behaved a lot better at first glance but if I would apply just a slightly heavier click it would freeze up for a sec while a really heavy click would really knock it out for current session. Having usb mouse plugged in and working the Touchpad still has the same failures. I just went to bios tried trapping the pad as if it's a piano, it has the same problem but with better response... To have it freeze up I really need to press touchpad/buttons heavily. Tho surely while in Windows it was by far a lot more sensor and easier to freeze up. Any suggestions from any wiz?
