ok final solution to the problem!
I flashed my card to the new settings and also made sure that the boot up clocks are the same as the clocks used when into windows.
I used Nibitor 5.2 and nvflash boot cd to permanently clock my card to 525/760 from 520/750 and uninstalled rivatuner. I did some tests to try and replicate the problem but it seems the problem is gone for good. My card is out of warranty so I didnt worry about that... I just dont like middle solutions unless I have to live with them... it seems that this time this was not the case
I hope this helps more people in the future.
NOTE: I also changed the boot up clocks because I had the feeling that the problem also occurred when the driver tried to change to the windows clocks. So the card is using the same clocks all the time.
