HDD breaking up, Can I legally install oem win 7 on new HDD

I am getting warnings of fatal errors on my HDD which contains Win 7 oem. Can I legally install the same Win 7 oem on a new replacement HDD which will be installed in the same desktop computer.
Help appreciated

Follow this with Disk Check.

If this is factory OEM preinstalled at factory you can make or order Recovery Disks to install to new HD if necessary.

If retail OEM just boot the DVD follow these steps to get a perfect Reinstall: Reinstalling Windows 7
