I am on Windows 7 , if I upgrade to Win 8.1 will I loose my files/data/pics/ installed games?

When you upgrade you should not lose anything, but it's always a good idea to back up your data first before you proceed on to the upgrade.

I would go a step further, make an image of your win 7 install. this way you can go back and try again if something goes wrong.
I would also make a separate backup of all user files.
