New approach to pirates?

Right now I'm very sick... It's horrible and my thinking process is very hazy, I was playing a few games on my PSP and it was hard to know what was going on.

Anyway, I just read a few articles about piracy from "TorrentFreak" and have thought of a more moral and simple solution to piracy. If a person gets caught, why not ask them to pay for the "file" which they shared at a reasonable cost? Instead of suing for $250,000-1,000,000 per file, why not ask them to pay the double the cost of the file. Or if they are truly generous, the original cost.

This may be better in my opinion.

I've always thought this is a much more logical approach to it. But I guess lawyers and what not want their cut and the industry is just too greedy. And I'm sorry about your fever, hopefully some antibiotics and cold towels will get that fever down quickly.

If you only had to pay for what you stole then everybody would just steal stuff and only pay for it when caught.

The problem with torrents and p2p programs is that you can never really know how many people downloaded the file or who/where they are. Millions of people download billions of files illegal on a regular basis. Right this minute I'm watching a anime that is not yet released in the US online. How did the file get there and with english subtitles? The person downloaded it and added the subtitiles themselve, most likely, and then uploaded for the world to see. Chances are, they also put the files somewhere that they can be downloaded from. That means instead of buying the DVD of the show when it comes out, people can just watch or download it online. If you fine the person who downloaded/created the illegal copy originally, they will only get the revenue for the first copy. What do they then do about the millions of copies downloaded? The chances are slime that those people will be caught and money is lost as well.

As I stated, I happily watch anime and read manga online and listen to music on Youtube. But at the same time I do buy manga/anime I enjoy when an official english version is released and buy the CDs of the music I really like. Do I have to? Obviously not. Why do I? I like to support people that entertain me. I also realize that if piracy did not exist, those people would be making a lot more money.

But more along your line of thinking, I have thought that these companies should make more exeptions than copyright laws do. Lets take AMVs for example. People take video clips of copyrighted material and replace the sound with copyrighted songs. Sounds illegal right? That is because it is. On the other hand, I started listening to flyleaf after watching an AMV with one of there songs in it. I ended up going to the mall and buying the deluxe version of their first CD. The same goes for Three Days Grace, except I have purchased all three of there CDs for myself and have bought other copies as gifts. I think if AMVs and similar fan created material were allowed, then more attention would be brought to certain bands and other works.

But I'll end my little rant now.

Excellent point, although, when they get caught, they're charged a ridiculous sum of money.

It's all a matter of deterrent - someone who knows that getting caught stealing is going to cost them far in excess of the actual cost of the item is worth is less likely to steal the item.

this deterrent is of course reliant on efficient policing of the item so the the likely hood of capture is high enough to make it a likely outcome.

Yep. The high fines are supposedly a deterrent to 'potential pirates' and those who are caught are made an 'example' of to fuel the 'deterrent'.

Cold towels? Hmm, you don't prefer to sweat a fever out? Usually when I get sick I sleep all day (and not look at my computers ), that usually helps. Getting knocked out for 3 days+, that sucks. Hope you're feeling better now.
