CPU doesn't throttle down when idle

I have a Core i5 750.
MSI GD65 motherboard.
Settings default no overclock.

In windows my power settings are at default.
When in balanced mode my cpu doesn't throttle down.
CPU-z shows that the multiplier is around 20-23 en core clock 3Ghz.

I looked at the individual settings Processor management is as follows min CPU at 5% / max CPU 100%

But is doesn't throttle down.

When I switch power plan to max Power saving it does clock down to multiplier x9 (core 1,2Ghz). But I notice that it doesn't throttle to full power when under load.

Anyone any suggestions?
In the BIOS Intel speedstep is enabled. S3 powersaving is also enabled

All processes are idle. So no process that really stands out.
Windows is a fresh install so not much additional software except for windows updates.

The weird thing is that CPU does throttle down when in power savings mode not in Balanced.

I checked both CPU range settings in Balanced and Power Saving modes and they are identical.
min CPU 5% and max CPU 100%
