Aero shake problem with windows sticking on top

Hello,
I am experiencing problem with aero shake. Once the windows are restored, by shaking the focused window again, it stays on top and there is nothing I can do about it except to close it..

If I do the same with another window, it is also set to `Always on top` and now I can override the first window. They are still on top anyway.

Can it be fixed? and how?

anyone have a solution? i am surprised i don't see this posted more frequently.. it is super annoying. i usually don't even use the aero shake intentionally --i accidentally activate it, so i shake again to restore.. but now my window is stuck in always-on-top mode. i end up having to close the entire application and reopen it. awful!
